How the title differs from the contract
A sale and purchase agreement records the obligations of the buyer and seller. Registration of the contract and transfer of title are different actions. When the title is transferred, the land registry record is changed to the name of the new owner. The agreement itself, the payment schedule, and the registration record for the contract do not replace the title transfer.

When the transfer of title can begin
It makes sense to begin preparations after checking the property itself and the chain of documents. For transactions involving a foreign buyer, it is separately verified whether a Permission to Purchase is required and whether the conditions applicable to the transaction have been met. Legislation on the acquisition of property by foreigners has changed, so an old contract cannot automatically be assessed under the rules of a new transaction.

Tapu ve Kadastro Dairesi accepts and processes property transfer transactions and also carries out valuations for tax and fee purposes. Therefore, the final list and calculation must be checked for the specific property at the district office where it is registered.

Do not rely only on a rate from an old article or on the seller’s calculation: the land registry valuation, the basis of the transaction, and the rules applicable to the participant may affect the amount and the list of payments.
How to do it
- Cross-check the agreement, appendices, property details, and the authority of all signatories.
- Request the current status of the title, restrictions, and documents required for the transfer.
- Check the Permission to Purchase or application status if this is required for the transaction.
- Obtain a calculation of the mandatory payments and allocate them between the parties in accordance with the agreement and the rules in force.
- Agree on a completion date at the district land office where the property is registered.
- After completion, obtain and retain the documents confirming the transfer and payments.
Why the transfer of title may be delayed
A delay does not always mean a refusal. Common reasons include the title for the specific property not yet being ready for transfer, discrepancies in the documents, the representative’s authority not being confirmed, or one of the required payments not having been settled. Restrictions in the land registry record and the status of the permission procedure for a foreign buyer are also checked separately.
Do not sign a new agreement to postpone the date, waive claims, or change the price before checking it against the main agreement and the actual payments. If the transaction is terminated, the issue of terminating it and the issue of the record of the registered contract are resolved separately.
