In the context of real estate in Northern Cyprus, Search is a request to the Tapu ve Kadastro Dairesi (the TRNC Land Registry and Cadastre Department) for official information on a specific property or on the ownership of a named person. The authority states that, upon request, it prepares a research document showing who owns a particular property. Such a document helps match the seller with registry data and identify registered encumbrances, but it does not replace a full review of the contract, construction, and the property’s actual condition.

What Search means

In English-language transaction practice, the word Search is usually used as a short term for checking registry information about real estate. In Turkish documents and on official websites, the terms araştırma belgesi and Tapu Mal Araştırma Belgesi are used. The name and contents of the document issued should be confirmed with the authority or the specialist submitting the request.

What information is checked

What Search does not confirm on its own

  • the actual area, boundaries, construction quality, and the presence of defects;
  • the legality of each structure, construction permits, and commissioning of the property;
  • connections to water, electricity, and other utilities;
  • the existence of debts that are not reflected in the registry being checked or relate to a separate contract;
  • the correctness of the contract terms and the possibility of obtaining permission to purchase in a specific situation.

Therefore, Search is one stage of due diligence, not a conclusion about the safety of the transaction. For a land plot, they also additionally check the land designation, boundaries, road access, and the possibility of the planned use.

What rules for foreigners need to be checked separately

Search shows information about the property and registered rights, but it does not confirm the right of a particular foreign buyer to purchase the selected type and number of properties. Under the general regime, you need to separately check the limit of up to 3 apartments, a plot for a detached house of up to 3,300 m², up to 2 two-storey detached villas in a residential complex, and the restriction on sales to foreigners of up to 80% of the units in a residential project. For citizens and companies of states that recognize the TRNC and provide reciprocal rights, separate limits have been published: up to 6 apartments or 3 two-storey detached villas. Exceptions and rules for related buyers depend on citizenship, status, and the specific transaction.

For apartments, they also check whether the total purchase on one plot exceeds the established limit for close relatives, in-laws, or foreigners of the same nationality. Search does not replace such a check based on the project and the composition of the buyers.

They also separately monitor the deadline: the stamped contract must be registered with the relevant district land office and an application for permission to purchase must be submitted within one month if the conditions set out in the applicable rules are met. This is a procedural check, not a result of Search.

Where Search fits in the purchase process

  1. Record the exact property: district, koçan, parcel, share, plan, and seller.
  2. Obtain and check the registry information before any non-refundable payment.
  3. Compare the Search with the draft contract, plan, and seller’s documents.
  4. Separately check the contract, permits, payments, and technical condition.
  5. Only after the results are aligned, decide whether to sign and proceed with further registration.

The TRNC Ministry of Interior website lists Tapu ve Kadastro Dairesi as the authority that handles title operations, cadastral information, mortgages, and research documents. In practice, the request procedure, the applicant’s authority, and the list of documents should be confirmed before submission.

The document may refer to cadastral identifiers and a plan, but the actual boundary on the ground needs to be compared with the plan and, if necessary, checked by a specialist.

Does Search replace a contract review?

No. Search checks the registry part, while the contract requires a separate review of the property, payments, deadlines, penalties, termination, and appendices.

Is Search enough for a foreign buyer?

No. A foreigner also needs to check the applicable purchase requirements, the documents for permission, and the subsequent registration actions.

Does Search check property limits and the project quota?

No. The limits for a foreign buyer, the land area, the foreigner quota in the project, and the deadlines for further actions need to be confirmed separately according to the current rules and documents of the specific transaction.
