How the purchase of an apartment, house, or plot in Northern Cyprus works

Updated: 2 months ago

The purchase of real estate in Northern Cyprus usually consists of several separate stages: selecting the property, checking Search, agreeing on the contract, registering it, fulfilling the requirements for a foreign buyer, making payments, completing title registration, and handover. The exact order depends on the type of property, the seller’s status, the stage of construction, and the contract terms. Before transferring a significant amount of money, the property must be fixed by cadastral data and the documents checked, rather than relying only on advertising or the seller’s promises.

Deal map

Stage What should be obtained in the end Main risk
Property selection Exact description of the apartment, house, or plot, cadastral data, and an agreed price. The buyer checks the wrong property or the wrong share.
Search Registry information about the owner, the property, and registered restrictions. The purchase is based on the seller’s words.
Contract Signed version with annexes, payment schedule, and handover terms. Different versions of the contract or incomplete annexes.
Registration and permits Submitted documents and confirmations of actions in the competent authorities. An obligatory stage is missed or an incomplete set is submitted.
Payments and title Payment confirmations and documents on subsequent registration of rights. Money is transferred without a clear basis or control over the result.
Handover Acceptance certificate, keys, meter readings, and a list of identified defects. The property is accepted without recording defects and missing items.

Step-by-step sequence

  1. Choose the property. Record the address, district, plot number, share, area, plan, and construction status.
  2. Carry out Search. Match the registry information with the seller, the plan, and the future subject of the contract.
  3. Check the contract. Separately verify the price, currency, deposit, payments, deadlines, annexes, liability, termination, and handover procedure.
  4. Sign and register the contract. Clarify the competent authority, filing procedure, and the established deadline for registering the stamped contract.
  5. Prepare the foreign buyer’s documents. The TRNC Ministry of the Interior publishes separate forms and lists for a purchase permit; the relevance of the package and the submission deadline must be confirmed on the transaction date.
  6. Make payments under the contract. Each transfer must have a clear purpose, recipient, and confirmation.
  7. Complete title registration and accept the property. Do not mix up handover of keys, actual readiness, and registration of the registered right.

Who is involved and what documents are needed

Depending on the transaction, the buyer, the seller or developer, the agent, the lawyer, Tapu ve Kadastro Dairesi, and the TRNC Ministry of the Interior unit dealing with property purchases by foreigners are involved. In the Ministry’s published list for a purchase permit, the required documents include an application, an information form, a copy of the passport, a copy of the koçan, a property plan, a criminal record certificate from the applicant’s country, and, if available, a copy of the contract. This list applies to the purchase permit, not automatically to the entire transaction.

For each side, one final version of the contract and annexes should be kept. If the document is signed by a representative, the scope of the power of attorney and the representative’s right to act in this particular transaction are checked before payment.

Restrictions for a foreign buyer

Before signing the contract, you need to check not only the property, but also the right of a specific foreign buyer to acquire the chosen type of real estate. The law provides, under the general regime, for up to 3 apartments, a separate house on a plot of no more than 3,300 m², or up to 2 two-storey detached villas in a residential complex. In a residential project, there is a restriction on sales to foreigners of up to 80% of the units. The applicability of exceptions depends on citizenship, the buyer’s status, and the specific property.

Question What needs to be checked
Number of properties Up to 3 apartments or up to 2 two-storey detached villas in a residential complex under the general regime; exceptions require separate verification.
Plot area Whether the plot exceeds 3,300 m² when buying a detached house and whether the planned use is allowed.
Residential project Whether the 80% limit on sales to foreigners in the project has been exceeded.
Deadline after the contract Whether the stamped contract has been registered with the relevant İlçe Tapu Amirliği and whether the application for a permit has been submitted within one month, subject to the prescribed conditions being met.
Buyer’s documents Whether the criminal record certificate matches the current validity period and the apostille requirement.

How to control payments

  • verify the recipient against the contract and official details;
  • state the payment purpose and keep the bank confirmation;
  • do not transfer money to a new account based only on a message in a messenger app;
  • match each payment with the schedule and the document it confirms;
  • separately record the refundable or non-refundable nature of the deposit in the contract text.

Handover and acceptance of the property

Before signing the acceptance certificate, the property must be checked against the contract and annexes: area, rooms, equipment, furniture, finishing condition, access, keys, meter readings, and identified defects. For a property under construction, actual readiness and the list of works that the seller or developer must complete are additionally recorded.

If you need to come to Northern Cyprus for viewing and acceptance, tickets can be compared via Trip.com, temporary accommodation can be found on Trip.com, and for trips between the property, the bank, and the authorities, car rental can be checked via Localrent. The terms and prices of the services should be checked before booking.

  • Koçan — a document confirming the registered right to the property.
  • Title — the registered right to real estate, which should not automatically be equated with the sale and purchase contract.

Frequently asked questions

What should be done first: sign the contract or order Search?

First, the property must be identified precisely and Search checked, then the final contract and payments are agreed. If negotiations require an early contract, its terms must explicitly take the verification results into account.

Can the handover of keys be considered registration of ownership?

No. The keys confirm factual transfer of access, but they do not replace registry and registration actions.

Does a foreigner need a separate permit to buy?

Yes, for a foreign buyer, the applicable requirements and permit procedure must be checked on the transaction date. In addition, it is necessary to verify the limits by type and number of properties, plot area, project restrictions, and the established deadlines for contract registration and application submission.

Can the whole process be carried out through a representative?

Some applications by foreigners are accepted in person, through a representative, or by a lawyer. The scope of the power of attorney and the need for personal participation at a specific stage must be confirmed in advance.

The procedure, documents, fees, and requirements for foreigners may change. Before the transaction, they must be confirmed with the competent TRNC authority and for the specific property.
